DMCA PROVISIONS
The Digital Millennium Copyright Act of 1998, found at 17 U.S.C. § 512 (“DMCA”), provides recourse for owners of copyrighted materials who believe that their rights under United States copyright law have been infringed upon on the Internet.

Under the DMCA, the bona fide owner of copyrighted materials who has a good faith belief that their copyright has been infringed may contact not only the person or entity infringing on their copyright, but may also contact the designated agent of an Internet service provider to report alleged infringements of their protected works, when such alleged infringements appear on pages contained within the system of the Internet service provider (ISP).

The owner of this website and the ISP are committed to complying with international trade law, international trade practices, all United States laws, including United States copyright law.

The website owner and/or the ISP will forward a copy of the notification of claimed copyright infringement to the alleged infringer. Anyone who believes in good faith that a notice of copyright infringement has wrongfully been filed against them, may submit a counter-notice to the website owner and/or the ISP.

To file a notice of infringement with either the website owner or the ISP, you must provide a written communication that sets forth the items specified below. You will be liable for damages (including damages, costs, and attorneys’ fees) if you materially misrepresent that the website or a web page is infringing your copyright. Accordingly, if you are not sure whether certain material of yours is protected by copyright laws, we suggest that you first contact an attorney.

To expedite our ability to process your request, please use the following format (including section numbers):

1. Identify in sufficient detail the copyrighted work that you believe has been infringed upon.

2. Identify the material that you claim is infringing the copyrighted work listed in item #1 above. (You must include the URL(s) (the location(s) of the page(s) that contains the allegedly infringing material and also include a description of the specific content which you claim is infringing on your copyright.)

3. Provide information reasonably sufficient to permit the website owner to contact you (e-mail address and a phone number are required at a minimum).

4. Include the following statement: “I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. I also affirm that as the copyright owner, I have a good faith belief that use of the material in the manner complained of is not authorized by me, my agent, or the law.”

5. The signature of the copyright owner or a person authorized to act on behalf of the copyright owner. You may send your notice via email provided such notice includes a proper electronic signature. The signature or electronic signature must be that of the copyright owner, or a person authorized to act on behalf of the owner, of an exclusive copyright that has allegedly been infringed.

For details on the information required for valid notification, see 17 U.S.C. § 512(c)(3).

COUNTERNOTIFICATION TO CLAIMED COPYRIGHT INFRINGEMENT
If a notice of copyright infringement has been filed with the website owner and/or the ISP against you, the owner and/or the ISP will attempt to notify you and provide you with a copy of the notice of copyright infringement. If you have a good faith belief that you have been wrongfully accused, you may file a counter-notification with the website owner and/or the ISP. If website owner and/or the ISP receives a valid counter-notification, the DMCA provides that the removed or blocked information will be restored or access re-enabled.

The website owner and/or the ISP will replace the removed material and cease disabling access to it in not less than 10, nor more than 14, business days following receipt of the counter-notification, unless the website owner and/or ISP first receives notice from the complaining party that such complaining party has filed an action seeking a court order to restrain the alleged infringer from engaging in infringing activity relating to the material on this website.

The United States copyright law provides penalties for a false counter-notice filed in response to a notice of copyright infringement. Accordingly, if you are not sure whether certain material of yours is protected by copyright laws, we suggest that you first contact an attorney.

Confidentiality

We remind you that everyone can read and use your comments. You do not have the possibility to erase your own comments; if you wish to have a comment removed, simply let us know through the ‘contact us’ page and we’ll do our best to honor your request.

Comments

Internet users commenting on skywalk-grand-canyon.com must behave with respect and honesty at all times.
Internet users may not post any commercial/advertising comment.
Internet users commenting on skywalk-grand-canyon.com must post information which is true and correct to their knowledge. Sources to health/medical claims must be provided when relevant.
We reserve the right to erase, without notification, any comment judged to be inappropriate.

Advertising Policies: Honesty in Advertising and Editorials

Editorials are posted and tagged as ‘editorial’. Advertisements are clearly marked as ‘advertisements’.

Parts of the skywalk-grand-canyon.com site are provided as a free service, and third-party advertising on those parts help us offset the significant and real costs of maintaining those pages as a free service.

Parts of the skywalk-grand-canyon.com may be provided as a membership site, and membership fees offset the costs of research and development of information provided to members. No advertising is allowed on those pages.

Whenever possible, we focus specifically on advertising solutions which we believe can add genuine value to the experience of visitors to this site.

Naturally, not every advertisement will be of interest to every visitor, but we make an effort to ensure that, on balance, the presence of advertisements enhances rather than detracts from our site.

Advertisements may not be posted by third parties anywhere on the site, they are permitted only in designated areas. Specifically, advertisements may not be posted without permission in areas such as the discussion forums (not yet available) or the actual blog pages at skywalk-grand-canyon.com, or other areas where individual visitors may modify the content of our site. All blog posts are reviewed before being published, and advertising references are removed.

We also provide a number of affiliate links. These affiliates offer revenue sharing to skywalk-grand-canyon.com. These are selected and approved where we have taken the time to personally evaluate a given product or service, or where they have been recommended by sources we trust, and where we believe that it provides value to our readers.

Our links to Amazon book pages are one example. Another example would include affiliate links to information sources and products such as photography, travel accommodations, car rentals, local tour companies, and other information or products. These are included if they are relative to Las Vegas, Grand Canyon West, Skywalk, and local topics of interest to visitors and guests. We believe advertising of this nature enhances the experience of our visitors at the same time it supports this site and complements our philosophy.

ABOUT CONTEXTUAL ADVERTISING

Some of the advertising presently displayed on skywalk-grand-canyon.com works via third party solutions from Google and others which intelligently assess which advertisements are pertinent to the content of the page being viewed.

This system carries two important benefits:

  1. Displayed advertisements should, ideally, be related to the context of what you are reading, and
  2. Advertising cannot bias the content or editorial policy of this site (because the advertising depends on what is written, rather than what is written being influenced by the interests of whatever third party is paying for the advertising).

In other words, we produce a skywalk-grand-canyon.com page as usual, without regard for the interests of any potential advertiser, and if a given advertisement is relevant to the contents of that page, then it may be displayed. We have no way of knowing in advance whether an advertiser will like what has been written, so we are not influenced in any way by advertisers appearing on this site through contextual targeting.

This contrasts with the traditional way of providing advertising, where the financial relationship between a site and an advertiser could compromise the editorial integrity of the site.

DISPLAYED ADVERTISEMENTS SUCH AS BANNERS, ETC.

Our website may host advertisements in the form of banners, display boxes, and sponsored links.

Advertisements are distinguished from posts, articles, editorials and other content by the word “Advertisement” prominently placed in close proximity to the advertisement.

As of this update, this site does not accept banners or other ads from link or banner exchanges. We may change this in the future and will update this policy when and if that change takes place.

Because contextual advertisements (such as banners and other ads) are displayed as a result of pertinence to page content (as described above), rather than as a result of explicit arrangement with skywalk-grand-canyon.com, we do not actually know in advance what advertisements may be displayed. Therefore, we cannot and will not make any comment on the advertisement nor provide any endorsement on the advertisers featured.

SPECIAL NOTE ON REVIEWS: DISCLOSURE POLICY

Our policy is to select and recommend those products and services that have superior or outstanding value in the field, and to recommend them to you.

We are sometimes able to develop a financial relationship with the manufacturers of products or providers of service such that we are paid a commission if someone buys that product or service after reading about it on this site.

We gladly accept payments, kickbacks, free ‘goodies’, and other types of incentive in exchange for providing an endorsement or positive review of a product or service; but we will not compromise our values in order to do this. That is, we will only recommend a product or service if we feel it provides superior or outstanding value.

If we ever change this policy or decide for whatever reason to make an exception to it, we will disclose it to you.

In all cases, we aim to provide honest-to-goodness, real-world reviews and not merely regurgitated ad-copy or press-release copy. Reviews are based upon our experience in practice and our knowledge as well as previous readings and reviews. We will not compromise our personal ethics or integrity by doing anything less.

ADDITIONAL FORMS OF ADVERTISING

We work with several forms of advertising and several types of advertisers. Please note that not all advertisements displayed on skywalk-grand-canyon.com are chosen automatically. As stated above, selected affiliate links have been included where we specifically recommend a given product or service (including Amazon affiliate links in our Research Library section).

Individual Advertisers: Contact Us for information on targeted advertising opportunities to see how you may be able to advertise on this site.

FEEDBACK ABOUT skywalk-grand-canyon.com ADVERTISING

Visitor feedback can be valuable in helping us shape our advertising options, and we welcome additional comments about our choice of advertising technologies and their impact on your use of the site. Please get in touch with us via the Contact Details page with any and all feedback about our advertising arrangements.

Financial Disclosures

Site owner may have received promotional copy, samples, and/or other material compensation as a professional courtesy, or he may have received a discount from the retail price, from the information or product provider. Familiarization tours – also known as ‘Fam Trips’ – are common in the travel industry in order to help potential sales agents tell people about, and hopefully sell their product.

We actively seek information and products in this area. We provides honest and professional opinion in our reviews, and we provide endorsement or no endorsement after reviewing the information or product.
